Applicability
1.1 These general terms and conditions apply to all offers, orders and agreements of Atelier Pomme that have been concluded with the buyer via distance selling. These General Terms and Conditions can be consulted at atelierpomme.nl. The General Terms and Conditions can be sent on request.
1.2 By accepting an offer or placing an order, the buyer declares to agree with these General Terms and Conditions.
Offers/Agreements
2.1 If an offer has a limited period of validity, Atelier Pomme will clearly state this.
2.2 Atelier Pomme will describe its products as accurately and truthfully. Obvious mistakes or errors do not bind Atelier Pomme.
2.3 Atelier Pomme will clearly state the rights and obligations of the consumer when accepting an offer. This includes stating the price, delivery costs, payment method and the right of withdrawal.
2.4 Atelier Pomme is entitled to refuse an order without giving any reason. There is only an agreement once Atelier Pomme has confirmed the order.
Right of withdrawal
3.1 After purchase, the consumer has the right to return an article without giving any reason within fourteen days, starting on the day of receipt by the consumer. If an article by its nature does not fall under the right of withdrawal, this will be stated by Atelier Pomme in the offer.
3.2 During the trial period, the consumer must handle the product and the packaging with care. If the consumer wishes to return an item based on the right of withdrawal, this must be unused, undamaged and in the original packaging. A seal must not be broken. The buyer must ensure proper packaging of the return shipment and bear the shipping costs.
3.3 Personalized items and facemasks are not subject to the right of withdrawal and may not be returned.
3.4 Upon return in accordance with the conditions and within the trial period, Atelier Pomme will refund the purchase price within 14 days.
3.5 You will receive your money back if we have received the return in good order and according to our conditions.
Prices and Payments
4.1 All prices for the products or services offered are in euros, including VAT and excluding shipping costs. Shipping costs are stated separately.
4.2 During the stated period of validity, Atelier Pomme will not increase prices, unless there is a change in VAT rates or extreme fluctuations in foreign currency that are important to Atelier Pomme.
4.3 Payment must be made using a payment method offered by Atelier Pomme. Studio Aimée cannot be obliged to accept another payment method. Atelier Pomme is entitled to attach further conditions to the payment. When paying by bank transfer, the day of payment is the day on which the amount is credited to the account of Atelier Pomme.
4.4 Payment must be made immediately after an order. If the amount due has been received by Atelier Pomme, the order will be processed and processed.
4.5. If the buyer remains in default, Atelier Pomme is entitled to postpone or dissolve the relevant agreement.
Delivery
5.1 The stated delivery times for the products are indicative with a maximum delivery time of 30 days. Exceeding the indicated delivery time does not entitle the buyer to compensation or cancellation of the order, unless the delivery time is so long that the buyer cannot reasonably be expected to maintain the agreement. In that case, SAtelier Pomme will return the purchase price to the buyer within 14 days.
5.2 The address specified by the buyer applies as the delivery address. Atelier Pomme is not liable for damage resulting from errors or imperfections in the delivery address specified by the buyer.
5.3 Deliveries only take place in the Netherlands. Atelier Pomme cannot be obliged to deliver to other countries.
Retention of title
6.1 All products or services delivered by Atelier Pomme remain the property of Atelier Pomme until the buyer has fulfilled all obligations under all agreements. The risk of damage or loss passes to the consumer from the moment of delivery.
Conformity and Warranties
7.1 Atelier Pomme ensures that ordered products or services comply with the agreement, the specifications stated in the offer and reasonable requirements of usability and soundness.
7.2 When a product, given its nature, is delivered under warranty and a defect occurs within the warranty period, the buyer must inform Atelier Pomme of this in writing or by e-mail.
